Dayly Terms of Use

These Terms of Use (“Terms”) govern your access to and use of Dayly, including the Dayly mobile app, Dayly widgets, daylybudget.com, the Dayly App Store listing, customer support, and related services (collectively, the “Service”). Dayly is operated by The Wavering Line LLC (“Dayly,” “we,” “us,” or “our”).

By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Eligibility

You must be at least 13 years old to use Dayly. Dayly is not directed toward children under 13. If you use Dayly on behalf of another person or organization, you represent that you have authority to accept these Terms on their behalf.

What Dayly Does

Dayly helps you track spending, set a monthly budget, calculate a daily budget, view budget history, receive reminders, use widgets, and access optional Pro features. Dayly is intended as a personal budgeting and productivity tool.

Dayly does not provide financial, investment, tax, legal, accounting, or professional advice. Any budgets, calculations, projections, reminders, summaries, insights, or other information shown in Dayly are for informational and organizational purposes only. You are responsible for your own financial decisions.

Your Responsibilities

You agree to:

  • Use Dayly only for lawful purposes.
  • Provide accurate information when you choose to enter information into Dayly.
  • Maintain the security of your device, Apple ID, backups, and app data.
  • Review your own budget, spending, and financial decisions before acting on them.
  • Comply with applicable laws, Apple App Store rules, and these Terms.

You agree not to:

  • Copy, modify, reverse engineer, decompile, disassemble, or attempt to extract source code from Dayly, except where allowed by law.
  • Interfere with, disrupt, damage, or misuse the Service.
  • Use Dayly to violate any law or the rights of another person.
  • Attempt to bypass purchase, entitlement, access, or security controls.
  • Misrepresent your identity or your relationship with any person or entity when contacting us.

App Data and Privacy

Your use of Dayly is also governed by our Privacy Policy, which explains how information is handled. The Privacy Policy is available at daylybudget.com and may also be linked from the App Store listing or inside the app.

Dayly is designed to store budgeting information locally on your device unless otherwise described in the Privacy Policy. You are responsible for keeping appropriate backups and protecting access to your device.

Purchases and Dayly Pro

Dayly may offer paid features, including Dayly Pro. Purchases are processed through Apple’s in-app purchase system and are subject to Apple’s payment terms, refund rules, and App Store policies.

Dayly Pro Lifetime is a one-time non-consumable in-app purchase that unlocks the included Pro features for the app, subject to these Terms, Apple’s rules, and the continued availability of the Service. Prices, features, and availability may vary by region and may change over time.

We do not control Apple’s payment processing, billing, taxes, refunds, purchase history, family sharing eligibility, or App Store account settings. To request a refund or manage App Store purchases, use Apple’s tools and support channels.

If a purchase is refunded, revoked, not verified, or otherwise invalidated, we may remove access to the associated paid features.

Changes to Features

We may add, change, suspend, or discontinue features of the Service at any time. We may also fix bugs, update calculations, change the design, adjust Pro features, or modify how the app works. We will try to avoid unnecessary disruption, but we do not guarantee that any feature will always be available in its current form.

Notifications and Reminders

Dayly may allow you to enable budget reminders and notifications. Notifications are provided for convenience only. We do not guarantee that notifications will be delivered, accurate, timely, or uninterrupted. Device settings, operating system behavior, Focus modes, permissions, and other factors may affect notification delivery.

Third-Party Services

Dayly may rely on or link to third-party services, including Apple services, the App Store, payment processing, website hosting, email, support, analytics, diagnostics, or other operational tools. We are not responsible for third-party services, websites, policies, content, products, or actions.

Ownership

Dayly, including its software, design, branding, text, graphics, logos, features, and other content, is owned by The Wavering Line LLC or its licensors and is protected by intellectual property laws.

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use Dayly for your own personal, non-commercial purposes.

These Terms do not transfer ownership of Dayly or any intellectual property rights to you.

Feedback

If you send us ideas, suggestions, feedback, bug reports, or other comments about Dayly, you grant us permission to use them without restriction or compensation to you. We are not required to use, keep confidential, or respond to feedback.

Disclaimers

The Service is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and reliability.

We do not guarantee that Dayly will be uninterrupted, error-free, secure, accurate, current, or compatible with every device, operating system, setting, or configuration. Budget calculations, insights, reminders, projections, and summaries may contain errors or may not reflect your complete financial situation.

Limitation of Liability

To the maximum extent permitted by law, The Wavering Line LLC and its owners, employees, contractors, agents, affiliates, service providers, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, business opportunity, or other intangible losses arising from or related to your use of the Service.

To the maximum extent permitted by law, our total liability for any claim arising from or related to the Service or these Terms will not exceed the greater of the amount you paid to us for Dayly in the 12 months before the claim or $50.

Some jurisdictions do not allow certain disclaimers or limitations of liability, so some of the above may not apply to you.

Indemnification

You agree to defend, indemnify, and hold harmless The Wavering Line LLC and its owners, employees, contractors, agents, affiliates, service providers, and licensors from and against claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising from or related to your misuse of the Service, violation of these Terms, violation of law, or infringement of another person’s rights.

Apple Terms

If you downloaded Dayly from the Apple App Store, you acknowledge that these Terms are between you and The Wavering Line LLC, not Apple. Apple is not responsible for Dayly or its content. Apple has no obligation to provide maintenance or support services for Dayly.

Your use of Dayly must comply with the App Store Terms of Service and any other applicable Apple terms. Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you as a third-party beneficiary.

If any Apple terms, including Apple’s standard licensed application terms, apply to your use of Dayly, those terms also govern your use of the app to the extent required by Apple.

Termination

You may stop using Dayly at any time. We may suspend or terminate your access to the Service if we believe you have violated these Terms, created risk or legal exposure for us or others, misused the Service, or if we discontinue the Service.

Sections that by their nature should survive termination will survive, including ownership, feedback, disclaimers, limitation of liability, indemnification, and dispute-related provisions.

Changes to These Terms

We may update these Terms from time to time. If we make changes, we will update the effective date above and post the revised Terms where they are made available, such as on daylybudget.com, the App Store listing, or inside the app.

Your continued use of Dayly after updated Terms become effective means you accept the updated Terms.

Governing Law

These Terms are governed by the laws of the State of Kansas, without regard to conflict of law principles, except where applicable law requires otherwise.
